BizGiver Full Terms & Conditions

  1. This competition (hereinafter the “Competition”) is run by BizCover™ Pty Ltd, of Level 2, 338 Pitt Street, Sydney NSW 2000 (“BizCover”). The Competition commences at 9am AEST Wednesday 17th April 2024 and concludes after a period of four (4) weeks at 11:59pm Wednesday 15th May 2024 (“Competition Period”).  
  2. By entering this Competition, you agree to these terms and conditions which will be binding between you and BizCover. Your participation in the Competition is in consideration for BizCover allowing you to enter it and giving you the opportunity to win.  
  3. Eligibility:
    1. Entry into the competition is open to registered Small Business entities in Australia who have a valid ABN. 
    2. Small Business is defined as a business having less than 20 employees and a turnover of less than $2 million AUD per year.  
    3. Entries can only be made in the business owner’s name, on behalf of their business only (the Participant).  
    4. Entrants must be over 18 years of age. 
    5. Participation is not open to:
      1. Employees of, or contractors to, the Sponsor or any of its agencies involved with the Competition; or
      2. The spouse, de facto spouse, parent, natural or adopted child, or siblings (whether natural or adopted by a parent) of such employees and contractors (whether or not they live in the same household).
  4. Upon the conclusion of the Competition Period, two (2) weeks will be required for BizCover to review entries and announce ten (10) semi-finalists at 12pm AEST Thursday 30th May 2024.The general public will have a period of one (1) week to use their vote to select the top three (3) finalists. The finalists will be announced at 12pm AEST Friday 7th June 2024. A further one (1) week will be required for BizCover staff to vote for one (1) of the three (3) finalists which will decide the overall winner. The winner will be announced at 12pm AEST Monday 17th June 2024. 
  5. This is a game of skill. Entrants may submit multiple entries during the Competition. Any entries submitted outside of the Competition Period will be deemed invalid and will be excluded from the Competition.  A total of one (1) prize up to the value of $5000 AUD, incl. GST, will be awarded for first place.    
    1. In order to enter the Competition, Entrants must submit their details to our competition through a Woobox form hosted on our BizGiver landing page bizcover.com.au/bizgiver 
    2. To register a valid entry, Entrants will be asked to create a video no longer than one minute in duration and answer to the prompt: “In a one-minute video or less, tell us about a product or service that will help you spark a new revenue stream, or just make your small business life a little easier.”Entrants must upload this video to the entry form along with the required submission information. A 20% additional time margin exceeding the 1-minute limit will be allowed. Submissions longer than the allowed additional time will be deemed invalid.  
    3. To make an eligible submission, entrants must include the video in the Woobox entry form as a required mandatory field in the entry form.
    4. BizCover will verify all entries by verifying that a viewable video content link has been provided by the entrant.
  6. Each entrant warrants to BizCover that each comment and any other contents submitted in their entry is an original creative work of the entrant that does not infringe the rights of any third party. Entries that contain prohibited or inappropriate content, or are otherwise in breach of these Terms and Conditions will not be eligible to win.
  7. The prize will consist of payment for the product or service nominated by the Participant on the Entry up to the value of $5,000 AUD (inclusive of GST); (the Prize).
  8. The notified Prize winner will be responsible for ordering the product or service the subject of the Prize and submitting the resulting tax invoice to the Sponsor within 6 weeks of the conclusion of the Promotional Period.
    1. The invoice must be made out to the Sponsor (BizCover Pty Ltd) and provided by email to marketing@bizcover.com.au.
    2. The email is to include the winner’s name in the subject line. The Sponsor will pay the invoice within 4 weeks.
    3. The invoice must be from a registered business with a valid ABN or company number and detail the Prize itemised.
  9. The Winner is required to get in contact with marketing@bizcover.com.au within 14 days of being notified of their win to remain eligible to receive the Prize.
  10. The Winner is required to complete a short questionnaire or interview about their business. The content of which will be used by the BizCover for PR and in other public domains to promote the Sponsor running the Promotion in the future and as customer spotlight.
  11. The Winner must also be available for a second interview by the Sponsor in the next 12 months to uncover how the Prize has impacted their small business. The Sponsor may request to shoot a spotlight video at the Winner’s business location or remotely. The content of which will be used in our PR and in other public domains to promote the Sponsor running the Promotion in the future and as customer spotlight.
  12. The Sponsor will not as part of the Promotion contribute to the cost of a product or service that has a total value in excess of the Prize.  The Prize is non-transferable and may not be redeemed for cash.
  13. Any images used to promote the Prizes are for information only. There is no cash alternative instead of the Prize. The Prizes are not transferable or exchangeable.
    1. The prize is only payable by the Sponsor directly to the business who provides the product or service chosen by the Winner. The Sponsor will not reimburse the Winner for any purchases outside of the Terms and Conditions in this competition.
  14. The ten (10) semi-finalists will be selected at the end of the Competition Period by a panel of representatives from BizCover (“Panel”) from the entries received in accordance with clause 5. The overall winner will be selected by BizCover from a list of three (3) finalists subject to internal vote by BizCover staff in accordance to clause 4.
  15. The semi-finalists will be entries determined by the Panel to be the best, based on creativity, value and answer to prompt provided in clause 5.
  16. The Panel will validate the votes to determine the ultimate winner. The Panel’s decision is final and binding and no correspondence will be entered into.
    1. The ten (10) semi-finalists, three (3) finalists and winner will be announced on the BizCover Facebook (https://www.facebook.com/BizCoverInsurance), Instagram (https://www.instagram.com/bizcoverau/), and TikTok (https://www.tiktok.com/@bizcover) social media pages at 12pm AEST on the 30th May, 7th June and 17th June 2024, respectively 
    2. The Winners will be contacted via email and their details, including their name and location, may also be posted elsewhere online, at BizCover’s discretion.
    3. Every reasonable effort will be made to contact the Winners, however if a Winner does not respond to BizCover in accordance to clause 9, the Prize will revert to BizCover and may be awarded to the next best eligible entrant who satisfies the Competition
  17. By participating in the Competition, each entrant consents to BizCover collecting and processing the personal information they submit to BizCover, for the purpose of administering the Competition and in accordance with BizCover’s Privacy Policy located at https://www.bizcover.com.au/privacy/ . BizCover will only share personal information with third parties, such as service providers and suppliers, as is necessary and for the sole purpose of administering the Competition. Entry is conditional on providing the requested personal information. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their personal information, how entrants may complain if they believe their privacy rights have been infringed and how those complaints will be dealt with. All entries become the property of BizCover.
  18. Except as otherwise required by applicable law, BizCover is not responsible for any loss or damage associated with an entrant entering into this Competition, the conduct of the Competition or the provision or otherwise of any aspect of any Prize or any act or omission of any other person or party, and all warranties, conditions and representations (of any kind) not expressly set out in these terms and conditions are hereby excluded.
  19. BizCover reserves the right to terminate or modify these Terms and Conditions, the Competition, or any Prize in accordance with applicable laws, should an entrant fail to comply with the stated Terms and Conditions or exhibit behaviour indicating a failure to comply. Furthermore, BizCover may, at its sole discretion, withdraw the Competition before notifying any Winners, or subsequently, if circumstances beyond BizCover’s control restrict the provision of the Prize or any element of the Prize by BizCover or any other involved party.
  20. An entrant may not assign or transfer their rights or obligations, or subcontract their obligations, under these Terms and Conditions, such as giving a Prize to anyone else, without BizCover’s prior written consent. BizCover may assign or transfer its rights or obligations, or subcontract its obligations, under these Terms and Conditions without an entrant’s consent.
  21. If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision and the other provisions of the terms and conditions will remain in full force and effect.
  22. These terms and conditions and all matters arising from or in connection with them are governed by the laws of New South Wales, Australia and the New South Wales courts will have exclusive jurisdiction in the event of any such dispute.
  23. Entry and continued participation in the Competition is dependent on entrants following and acting in accordance with:

  28. This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram, or TikTok. Entrants understand that they are providing their information to BizCover and not to Facebook, Instagram, or TikTok. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this Competition must be directed to BizCover and not to Facebook, Instagram, or TikTok. Facebook, Instagram, or TikTok will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the Competition (including taking/use of a prize), except for any liability which cannot be excluded by law.
  29. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of BizCover, including but not limited to technical difficulties, unauthorised intervention or fraud, BizCover reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate.
  30. Incomplete or indecipherable entries and entries that do not comply in full with these Terms and Conditions will be disqualified.
  31. BizCover reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who BizCover has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Errors and omissions may be accepted at BizCover’s discretion. Failure by BizCover to enforce any of its rights at any stage does not constitute a waiver of those rights. BizCover’s legal rights to recover damages or other compensation from such an offender are reserved.
  32. If there is a dispute as to the identity of an entrant, BizCover reserves the right, in its sole discretion, to determine the identity of the entrant.
  33. BizCover reserves the right to substitute the Prize (or any part thereof) for a prize or prizes of equivalent or greater monetary value if this is necessary for reasons beyond its reasonable control. If a winner does not claim a Prize by the time specified by BizCover, the Prize will be forfeited.
  34. Any cost associated with accessing the competition is the entrant’s responsibility and is dependent on the Internet service provider used.
  35. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, BizCover (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.
  36. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, BizCover (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under BizCover’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by BizCover) due to any reason beyond the reasonable control of BizCover; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (g) taking/use of and/or participation in a Prize.
  37. Entrants agree that they are fully responsible for any materials they submit via the Competition including but not limited to video responses to the promotional prompt (“Content”). BizCover shall not be liable in any way for such Content to the full extent permitted by law. BizCover may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that:
  38. they will not submit any Content that is unlawful or fraudulent, or that BizCover may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
  39. their Content shall not contain viruses or cause injury or harm to any person or entity;
  40. they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
  41. the Content is the original work of the entrant that does not infringe the rights of any third party;
  42. they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
  43. they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.
  44. Without limiting any other terms herein, the entrant agrees to indemnify BizCover for any breach of the above terms.
  45. As a condition of entering this Competition, each entrant licenses and grants BizCover, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry submitted through the Competition link (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
  46. Entrants consent to BizCover using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by BizCover.
  47. Entrants consent to receive marketing communications not limited to e-mail, social media, SMS or via phone in regards this Competition or any future marketing activities by BizCover. The entrant can opt-out from BizCover communications both online and offline at any time.
